Please read this Terms of Service (“Terms,” “Terms of Service”) carefully before using our website (“our website,” https://wpturnedup.com) operated by WP Turned UP, a(n) Sole Proprietorship formed in North Carolina, United States (“us,” “we,” “our”) as this Terms of Service contains important information regarding limitations of our liability.

Your access to and use of our website is conditional upon your acceptance of and compliance with these Terms. These Terms apply to everyone, including, but not limited to, visitors, users, and others who wish to access and use our website.

You agree to be bound by these Terms by accessing or using our website. If you disagree with any part of the Terms, you do not have our permission to access or use our website.

Premium Solution Licensing

Some of our services include access to a library of licensed premium solutions.

  • We own the accounts and licensing for all premium solutions. Therefore, vendors will only provide WP Turned UP with direct support. Contacting vendors for support is prohibited unless you have purchased your licensing.
  • Chargeback attempts will result in immediate and permanent loss of all premium solution licensing.
  • While we do not foresee any issues and will always do our best to ensure the licensing of premium solutions remains undisrupted, we cannot guarantee that premium solutions will be licensed indefinitely.
  • We reserve the right to permanently revocate all premium solution licensing without notice if customers or clients generally act in bad faith or are abusive or disrespectful towards any WP Turned UP employee.

Products

Our products are not to be resold or redistributed. Doing so will result in an immediate and permanent ban from WP Turned UP and an immediate and permanent loss of all licensing and access to the associated products, as applicable.

Termageddon

We offer the Termageddon policy solution at a discount as part of an annual subscription.

Payment

Customers are automatically billed and are responsible for making payments when they are due.

Failed Payment Schedule

  • Initial Notice: Failed payment notifications are sent out immediately.
  • Forced Cancellation: If payment is not made by the 14th day of the customer’s billing cycle, their Termageddon account, along with all associated policies, are deleted.

Services

Managed Website, Website Care & Kinsta Hosting

We offer Kinsta WordPress Hosting as a stand-alone service and as part of the Managed Website and WordPress Website Care services.

Communication

Customers must use a valid email address regularly reviewed for incoming communication when signing up for these services. We will use the customer’s email address on file for communication, and the customer should ensure that emails from our domain (influencewp.com) can be successfully received.

Payment

Customers are automatically billed as part of a monthly subscription and are responsible for making payments when they are due.

Failed Payment Schedule

This schedule is critical for avoiding loss of service.

  • Initial Notice: Failed payment notifications are sent out immediately.
  • Forced Cancelation: If payment is not made by the 14th day of the customer’s billing cycle, their website is backed up and then deleted from our Kinsta hosting account, website care (if applicable) is terminated, and all licensing (if applicable) is terminated.

Deleted Websites

The following applies if a website has been deleted from our Kinsta hosting account due to failed payment as outlined in the ‘Failed Payment Schedule.’

  • We are not obligated to back up, supply, or restore deleted websites.
  • Deleted websites need to be restored by Kinsta or the customer, and if that is not possible, we will charge a one-time fee to assist with restoration.
  • Our prices change, so customers who sign back up are not guaranteed to get their previous subscription price.

Malware Cleanup & Potential Fees

If your website becomes infected with malware, Kinsta will clean it up for free as part of its ‘Security Pledge.’ Kinsta is providing this free service that customers would otherwise have to pay someone to complete for them, so it only makes sense for customers to work with Kinsta to ensure the integrity of their website.

As part of that cleanup, Kinsta typically requires follow-up tasks to ensure the security and integrity of your website. Kinsta communicates the follow-up tasks to the Kinsta account holder (WP Turned UP), and we will then relay those tasks to you.

You must complete any required follow-up tasks immediately and confirm with us that you have done so. Otherwise, you are subject to a $100 fee to reimburse us for covering the fees levied by Kinsta. Additionally, Kinsta may disqualify your website from being covered under the ‘Security Pledge’ and no longer provide free malware removal services for your website.

If we get charged a $100 cleanup fee and are not reimbursed, we reserve the right to take the necessary steps to recoup the fee, including, but not limited to, locking access to the site (back and front end).

Hosting Ban

Customers who have had their website removed from our Kinsta WordPress Hosting more than once or fail to comply with the ‘Malware Cleanup’ procedures outlined in the previous section will no longer be permitted to sign up for this service.

We reserve the right to permanently ban customers who generally act in bad faith or are abusive or disrespectful towards any WP Turned UP employee.

Kinsta Disk Space Add-on

We offer 20GB disk add-ons for our Kinsta WordPress Hosting offering for those needing more hard disk space, and we don’t mark up the price. Our clients pay what we pay, as we are simply passing our costs onto them. As such, we have a strict policy for collecting payment.

Failed Payment Schedule

This schedule is critical for avoiding additional penalties and loss of service.

  • 1st Notice: Failed payment notifications are sent out immediately.
  • 2nd Notice: If payment is not made by the 7th day of the customer’s billing cycle, failed payment notifications are sent out, and the customer must pay a $7.00 late fee.
  • Final Notice: If payment is not made by the 14th day of the customer’s billing cycle, failed payment notifications are sent out, and the customer must pay a $14.00 late fee.
  • Forced Cancelation: If payment is not made by the 21st day of the customer’s billing cycle, their website is deleted from our Kinsta hosting account, and services are canceled.

Website Support

We offer Website Support as a stand-alone service. Purchased support time cannot be used for custom development and must be used within six months of the purchase date, or it will be forfeited.

Custom Development

We offer Custom Development as a stand-alone service. This service is only available to our Managed Website and WordPress Website Care clients.

Once we deliver a solution as part of this service and the customer signs off on a project’s completion, we become the solution owner and retain all rights to it. Customers may use the solutions on their websites but are not to compete with us by giving away or reselling the solution.
